All service levels in View's adviser facilitated estate planning include an online meeting with the customers.
This meeting is necessary so that we can issue our independent advice certificate for the adviser's file.
The certificate confirms that View Legal has provided all legal advice (not the adviser firm) to the customer in relation to the estate planning documents drafted by View.
In some instances, we will issue a qualified Independent Advice Certificate.
Those circumstances include:
- where an adviser chooses to proceed with a Compliance package, notwithstanding that we have recommended that the factual matrix makes that service level inappropriate
- where we have recommended a particular drafting approach, and the adviser or customer have rejected our advice.
In these circumstances, we are required from an insurance perspective to either not issue the certificate of independent advice or issue it with qualifications.
If this happens, we recommend adviser firms have their licensee review the situation to confirm if they will have insurance cover. Based on previous experience, most advisers prefer to ensure an unqualified certificate is issued by View, including in situations where an adjustment to View's scope and pricing is required.
